Use of the Site

You may use the Site for personal, non-commercial purposes to research real estate in Brevard County, Florida and to contact Melissa Jacques about real estate services. You agree not to:

• Scrape, crawl, or systematically download listings, photographs, or other Site content

• Reproduce, republish, or redistribute Site content without written permission

• Interfere with the Site's operation, security, or other users' access

• Submit false, misleading, or automated information through the contact or valuation forms, or attempt to circumvent reCAPTCHA or other anti-abuse measures

• Use the Site in any way that violates law or these Terms

Listing and MLS Data

Listing information displayed on the Site is provided by the Space Coast Association of REALTORS® Multiple Listing Service and other cooperating sources, and is displayed exclusively for consumers' personal, non-commercial use. It may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. The information is deemed reliable but is not guaranteed by the MLS or by Melissa Jacques. Prices, availability, status, square footage, lot size, taxes, school assignments, and other details are subject to change or error and should be independently verified by you and, where appropriate, by a licensed professional before any offer is made.

Photographs, descriptions, and other listing content are provided by the listing brokerage and remain the property of that brokerage or the underlying rights holder.

No Agency Relationship

Your use of this Site does not, by itself, create an agency relationship between you and Melissa Jacques or between you and Legacy Real Estate Partners. Until a written brokerage agreement is signed, no brokerage relationship exists. Under Fla. Stat. § 475.278, when a brokerage relationship is formed, a Florida licensee is presumed to operate as a transaction broker unless a single-agent or no-brokerage-relationship disclosure is signed.

Intellectual Property

Site design, branding, text that is not MLS-sourced, photography that is not MLS-sourced, and other original content are the property of Melissa Jacques or Legacy Real Estate Partners, and are protected by U.S. copyright and trademark law. You may print or save individual pages for personal use. All other use requires prior written permission.

Photographs of properties not listed by Melissa Jacques are displayed under IDX license and remain the property of the listing brokerage or original rights holder; no right to copy, redistribute, or reuse those photographs is granted by these Terms.

Third-Party Links

The Site links to third-party websites (social media, the brokerage, the MLS, HUD, and others). We do not control those sites and are not responsible for their content, privacy practices, or availability. Your use of a linked site is at your own risk and is governed by that site's terms.

Disclaimers

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Melissa Jacques and Legacy Real Estate Partners disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components.

Nothing on the Site constitutes legal, tax, financial, appraisal, or inspection advice. You should consult a qualified professional before making real estate decisions.

Limitation of Liability

To the fullest extent permitted by law, neither Melissa Jacques nor Legacy Real Estate Partners nor their respective affiliates, agents, or licensors will be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, including without limitation damages for loss of data, loss of profits, or business interruption, even if advised of the possibility of such damages. In all cases our aggregate liability for claims arising out of or relating to the Site is limited to one hundred U.S. dollars ($100). Nothing in this Section limits liability that cannot be limited or excluded under applicable Florida law, including claims that cannot be waived under the Florida Deceptive and Unfair Trade Practices Act.

Indemnification

You agree to defend, indemnify, and hold harmless Melissa Jacques and Legacy Real Estate Partners from any claim, demand, loss, or damages arising out of your misuse of the Site or your breach of these Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state courts located in Brevard County, Florida, or in the U.S. District Court for the Middle District of Florida, and you consent to personal jurisdiction and venue there.

Changes to These Terms

We may change these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will provide additional notice on the Site where practical. Continued use of the Site after changes are posted means you accept the updated Terms.
